Trump attorneys say presidents can’t be prosecuted for promoting pardons or ordering murders

Former president Donald Trump’s lawyer advised a three-judge panel of the US Courtroom Appeals for the District of Columbia Circuit {that a} president could be immune from prosecution until impeached and convicted, even when he was accused of getting ordered a rival’s homicide by the US army.

Throughout arguments in a Washington, DC courtroom on Tuesday, Trump lawyer D John Sauer advised Judges Michelle Childs, Florence Pan and Karen Henderson that Mr Trump is immune from prosecution below the impeachment and double jeopardy clauses of the US Structure, citing the Senate’s 2021 aquittal of the ex-president on costs that he incited the January 6 assault on the Capitol.

Choose Florence Pan, a 2022 appointee to the circuit court docket by President Joe Biden, virtually instantly started a rapid-fire questioning of Trump lawyer D John Sauer over his competition.

She requested Mr Sauer if, hypothetically, a president might order the killing of a rival by the US army or promote pardons and be immune from any authorized penalties.

He replied that prosecution would solely be allowed following a conviction by the Senate.

She interjected to repeat the question after Mr Sauer’s filibustering reply: “I requested you a sure or no query. May a president who ordered SEAL Workforce 6 to assassinate a political rival … would he be topic to felony prosecution?”

He replied: “Certified sure — if he’s impeached and convicted first.”

He later added that in his view, such a president would “must be, and would speedily be, you understand, impeached and convicted earlier than the felony prosecution”.

James Pearce, the Assistant Particular Counsel who argued the case for the US authorities, mentioned Mr Sauer’s feedback portended “an awfully scary future” as a result of his view would place presidents largely outdoors and above the regulation.
